Privacy Policy
How Superior Rigging & Comms Pty Ltd collects, uses, stores and discloses personal information under the Privacy Act 1988 (Cth).
1. About this policy
This policy explains how Superior Rigging & Comms Pty Ltd (ABN 89 699 958 177, ACN 699 958 177) handles personal information. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act, and this policy is our APP 1 statement of how we manage personal information.
In this policy, "personal information" has the meaning given to it in the Privacy Act 1988 (Cth): information or an opinion about an identified individual, or an individual who is reasonably identifiable.
2. Information we collect
We collect only the personal information reasonably necessary for our functions and activities as a rigging and communications infrastructure contractor. Depending on your dealings with us, this may include:
- your name, job title and the organisation you represent;
- contact details such as your email address, telephone number and postal address;
- site and project details you provide when making an enquiry, including site addresses and access arrangements;
- correspondence between you and us, including enquiry and quotation records;
- information relating to the supply of goods and services, including purchase orders, invoices and payment records;
- for workers, contractors and job applicants: licence and competency details, qualifications, work history and information required to meet our work health and safety obligations; and
- technical information generated when you use this website, as described in section 6.
We do not seek sensitive information as defined in the Privacy Act 1988 (Cth) unless it is reasonably necessary for our activities and you consent, or the collection is otherwise required or authorised by law — for example, health information relevant to fitness for high-risk work, or information collected following a workplace incident.
3. How we collect it
Wherever it is reasonable and practicable to do so, we collect personal information directly from you. That generally happens when you email us, complete the enquiry form on this website, engage us for works, supply goods or services to us, attend one of our sites, or apply for work with us.
We may also collect personal information from third parties where you would reasonably expect it — for example from a principal contractor engaging us on a project, from a referee you have nominated, or from a publicly available source such as a business register.
4. Why we collect and use it
We collect, hold, use and disclose personal information for purposes connected with our business, including to:
- respond to enquiries and prepare quotations, lift studies and method statements;
- plan, supervise and perform rigging, erection and communications works;
- meet our work health and safety duties, including site inductions, competency verification and incident investigation;
- administer contracts, invoicing, payment and record keeping;
- manage our workers, contractors and recruitment; and
- comply with our legal and regulatory obligations.
Where we use your information for a purpose other than the one for which it was collected, we will only do so where that secondary purpose is related to the primary purpose and within your reasonable expectations, where you have consented, or where the use is required or authorised by law.
We do not sell personal information, and we do not use it for direct marketing without a clear means of opting out.
5. Disclosure to others
We may disclose personal information to:
- our workers and contractors, so far as they need it to perform the work;
- principal contractors, builders, site occupiers and asset owners where disclosure is necessary to gain site access or to coordinate works;
- crane, plant and equipment suppliers engaged for a specific job;
- professional advisers such as accountants, insurers and lawyers;
- service providers who host our systems or process payments on our behalf; and
- regulators, courts or other bodies where disclosure is required or authorised by law.
Where we engage a service provider, we take reasonable steps to require them to handle personal information consistently with this policy and the Australian Privacy Principles.
6. Website, cookies and logs
This website is a static site. It does not set advertising or tracking cookies, does not embed third-party analytics or social media scripts, and does not load fonts, images or scripts from external services.
Our hosting provider records standard technical information when a page is requested, which may include your internet protocol (IP) address, the date and time of the request, the page requested, and details of your browser and operating system. This information is used to deliver the site, maintain its security and diagnose faults. It is not used to identify you, and we do not attempt to combine it with other information about you.
The enquiry form on our contact page does not transmit anything to a server. It opens a message in your own email application, which you then choose to send. If you send it, the message reaches us as an ordinary email.
7. Storage and security
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include restricting access to systems and records to people who need it, using access controls and reputable hosted services, and securely destroying or de-identifying records we no longer need.
No method of transmission or storage is completely secure. Email in particular is not a secure channel, and information you send us by email travels at your own risk.
If we suffer a data breach that is likely to result in serious harm, we will assess and respond to it in accordance with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth), including notifying affected individuals and the Office of the Australian Information Commissioner where required.
8. How long we keep it
We keep personal information only for as long as it is needed for the purpose it was collected, or for as long as we are required to keep it by law. Project, safety and financial records are generally retained for the periods required under work health and safety, taxation and corporations legislation, and for the period in which a claim relating to the work could still be brought. When information is no longer needed and we are not required to retain it, we destroy or de-identify it.
9. Access and correction
You may ask us for access to the personal information we hold about you, and you may ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Requests should be sent to [email protected].
We will ask you to verify your identity, and we will respond within a reasonable period. Access is provided free of charge, although we may charge a reasonable fee for the cost of retrieving and supplying information in some circumstances. If we refuse access or a correction, we will tell you why in writing and explain how you may complain about that decision, except where the Privacy Act 1988 (Cth) provides otherwise.
You may deal with us anonymously or under a pseudonym where it is lawful and practicable to do so, although we usually cannot quote for or perform works without knowing who we are dealing with.
10. Complaints
If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please tell us first. Email [email protected] with the details of your complaint. We will acknowledge your complaint, investigate it, and give you a written response within a reasonable period.
If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC), which is the regulator responsible for privacy in Australia. The OAIC can be contacted through its website at oaic.gov.au or by telephone on 1300 363 992.
11. Overseas disclosure
We do not routinely disclose personal information to overseas recipients. Some of the hosted services we use to run our website and email may store data on servers located outside Australia. Before disclosing personal information to an overseas recipient, we take the steps reasonable in the circumstances to ensure the recipient does not breach the Australian Privacy Principles in relation to that information, as required by APP 8.
12. Changes to this policy
We may update this policy from time to time to reflect changes in our practices or in the law. The current version is always the one published on this page, and the date it was last updated appears at the top.
